Terms of Service
The agreement between you and Aero Imagery for use of the Aero Imagery Desk platform.

Please read these Terms of Service carefully before using the Aero Imagery Desk platform. By creating an account or using the platform, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Aero Imagery Desk platform, website, and related services (the "Service") operated by Aero Imagery ("we", "us", or "our"), ABN 38 354 218 941.
By creating an account, logging in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
If you are using the Service on behalf of a business, you confirm that you have the authority to bind that business to these Terms, and the business will be responsible for your use of the Service.
2. Definitions
- "Service" means the Aero Imagery Desk platform, including all features, tools, and interfaces provided through the website and app.
- "User" or "Pilot" means any person who creates an account and uses the Service to manage their drone piloting business.
- "Client" means a pilot's customer — a person or business that the pilot enters into the Service for job tracking, quoting, or invoicing. Clients are not users of the Service.
- "Content" means all data a User enters or uploads, including client details, job information, quotes, invoices, expenses, compliance documents, equipment records, and portfolio images.
- "Subscription" means a paid plan that unlocks features of the Service beyond the trial period.
- "Public Directory" means the optional, opt-in listing of pilot profiles visible to the public.
3. Eligibility & Accounts
Age requirement. You must be at least 18 years old to use the Service. By creating an account, you confirm that you are 18 or older.
Account registration. You must provide accurate and complete information when creating your account, including a valid email address. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
One account per person. You may not create multiple accounts to circumvent trial limits, subscription restrictions, or referral program rules.
Account security. You must notify us immediately if you become aware of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access.
4. The Service
Aero Imagery Desk is a business management platform designed for professional drone pilots. The Service provides tools for:
- Job tracking and scheduling
- Client management
- Quote and invoice creation
- Expense tracking and financial reporting
- Equipment and maintenance management
- Compliance document storage (CASA RePL, ReOC, insurance, medical)
- Optional Google Calendar synchronisation
- An AI assistant for operational guidance
- An optional public pilot directory for lead generation
- Stripe Connect integration for processing client payments
Not operational oversight. The Service is a management tool only. We do not supervise, direct, or take responsibility for your drone operations, flight decisions, compliance with aviation regulations, or the conduct of your business. You remain solely responsible for complying with all applicable laws, including Civil Aviation Safety Authority (CASA) regulations, at all times.
We may modify, suspend, or discontinue any feature of the Service at any time. We will provide reasonable notice of significant changes.
5. Subscriptions & Billing
Trial period. New users receive 30 days of full access to the Service ("Platinum trial") at no cost. No credit card is required to start the trial. The trial begins when your account is created and expires automatically after 30 days unless you subscribe to a paid plan.
Paid plans. We offer several subscription plans (Apprentice, Premium, Platinum, Pro Solo, Pro Team, and Pro Studio). Plan features and pricing are displayed within the Service and may change from time to time. Subscriptions are billed in Australian dollars (AUD) and include GST where applicable.
Stripe. Subscription payments are processed through Stripe. By subscribing, you authorise us to charge the selected payment method through Stripe for the duration of your subscription until you cancel.
Stripe Connect. The Service integrates with Stripe Connect to allow you to process payments from your clients (deposits and invoice payments). Your use of Stripe Connect is subject to Stripe's own terms and conditions. We are not a party to the payment relationship between you and your clients, and we do not hold or control funds processed through your Stripe account.
Referral program. We may offer a referral program allowing users to earn discounted subscription periods by referring new users. Referral rewards are subject to the program rules displayed within the Service, including any caps on the number of referrals and the duration of rewards. We may modify or discontinue the referral program at any time.
Cancellation. You can cancel your subscription at any time through the Service. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the period you have paid for.
Refunds. Nothing in these Terms excludes any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be lawfully excluded. Subject to that, we do not offer refunds on subscription fees. The only exception is if you accidentally subscribe or upgrade: you may request a refund of that single most recent payment by contacting us at support@aeroimagery.com.au within 24 hours of the charge. The 24-hour refund applies only to that one payment. We do not provide refunds for any earlier billing periods — for example, if you have been subscribed for months or years, you cannot request a refund for those past periods, even if you are unhappy with the Service. To cancel going forward, use the cancellation option in the Service; cancellation stops future charges and takes effect at the end of your current billing period.
Price changes. We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice.
6. Acceptable Use
You agree not to use the Service to:
- Violate any Australian or international law, including CASA regulations and privacy laws
- Upload or enter information that is unlawful, misleading, defamatory, or infringes the rights of others
- Collect or store client data without proper consent or authority
- Share, sell, or transfer your account to another person
- Attempt to gain unauthorised access to other users' data or the Service's systems
- Scrape, harvest, or extract data from the Public Directory for commercial purposes unrelated to finding a pilot
- Use the Public Directory to post jobs, solicit sign-ups, or advertise services
- Introduce viruses, malware, or any code that could disrupt the Service
- Use the AI assistant to generate content that is unlawful, harmful, or deceptive
- Circumvent billing, trial limits, or feature restrictions
Violation of these rules may result in suspension or termination of your account, and we may remove content or public profiles that breach these terms.
7. User Content & Data
Ownership. You retain ownership of all Content you enter or upload to the Service. We do not claim ownership of your business data, client information, financial records, or compliance documents.
Licence to us. You grant us a non-exclusive, worldwide licence to host, store, process, and display your Content solely as necessary to provide and operate the Service for you. This licence ends when your account is deleted and your data is permanently removed.
Your responsibilities. You are responsible for:
- Ensuring you have the right and authority to enter all Content, including client personal information
- Complying with the Privacy Act 1988 and other privacy laws in relation to client data you collect and store
- The accuracy and legality of all Content you enter
- Maintaining your own copies and backups of important data — we are not your sole data custodian
Client data. When you enter client information into the Service, you are the data controller for that information. We process it on your behalf as your service provider. You must ensure you have appropriate consent from your clients to store their information in a third-party platform.
8. Public Pilot Directory
The Service includes an optional Public Directory where pilots can list their business for potential clients to discover.
- Opt-in only. Your profile is only published if you choose to submit it, and it is subject to moderation and approval by us before it appears publicly.
- Moderation. We reserve the right to approve, reject, edit, or remove public profiles at our discretion to maintain the quality and integrity of the directory. Moderation is a quality-control measure only and does not constitute endorsement, verification, or a warranty of any pilot's competence, qualifications, insurance, or reliability.
- Introduction service only. The directory is a listing and introduction service. It does not facilitate job posting, sign-ups, or payments between clients and pilots, and we are not a party to any engagement, contract, or transaction between a client and a pilot.
- No endorsement or warranty. A listing in the directory is not a recommendation or endorsement by us. We do not warrant that any listed pilot is qualified, insured, licensed, competent, or suitable for any particular work. Any client who contacts a pilot through the directory does so entirely at their own risk and must make their own independent assessment of that pilot.
- No liability for engagements. To the maximum extent permitted by law, we are not liable for any act, omission, loss, damage, injury, or harm arising out of or in connection with any engagement, work, or relationship between a client and a pilot, however that engagement was formed — including where the client found the pilot through the directory. We do not control, direct, supervise, or oversee the work performed by any pilot.
- Accuracy. You must ensure your public profile information is accurate and not misleading.
- Lead capture. When a potential client contacts you through the directory, their message is forwarded to you. You are responsible for how you handle that enquiry and any resulting business relationship.
9. Intellectual Property
Our rights. The Service, including its software, design, branding, document templates, and features, is owned by Aero Imagery and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
Document templates. The invoice, quote, and other document templates provided within the Service are licensed to you for your business use while your subscription is active. You may not resell or redistribute these templates.
Your rights. You retain all intellectual property rights in your Content, including your logo, brand materials, portfolio images, and business documents.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.
11. Limitation of Liability
Consumer guarantees. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or other applicable law that cannot be lawfully excluded. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to, at our option, the cost of resupplying the Service or the cost of having the Service resupplied.
Service provided "as is". To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, secure, or that your data will never be lost or corrupted.
Excluded losses. To the maximum extent permitted by law, we are not liable for any indirect, consequential, special, or punitive damages, or for any loss of profit, loss of revenue, loss of business, loss of opportunity, loss of goodwill, or loss or corruption of data, arising out of or in connection with the Service.
Liability cap. Our aggregate liability for any claim arising out of or in connection with these Terms or the Service is limited to the amount you have paid us for the Service in the 12 months preceding the event giving rise to the claim, or AUD $100, whichever is greater.
No operational liability. The Service is a management and administrative tool only. We do not control, direct, supervise, oversee, or take any part in your drone operations, flight decisions, job execution, or the conduct of your business. To the maximum extent permitted by law, we are not liable for your drone operations, flight decisions, compliance with aviation regulations or any other law, or any outcome of your business — including any damage, injury, loss, or harm arising from your work or your conduct of your business.
Your own responsibility. You are solely responsible for your own information, business tasks, and decisions. You are responsible for the accuracy and legality of everything you enter into the Service, for the safety and legality of your operations, and for the consequences of your actions as a business. We do not verify, audit, or warrant the correctness, safety, or lawfulness of anything you do with the Service or in your business.
No liability for directory introductions. Where a client engages a pilot through or after discovering them via the Public Directory, we are not liable for any act, omission, loss, damage, injury, or harm arising out of or in connection with that engagement or the pilot's work. We are not a party to any client-pilot relationship and do not control, supervise, or warrant the work performed by any pilot.
No liability for third-party services. We are not liable for the acts, omissions, or availability of any third-party service you connect to or use through the Service, including Stripe, Google Calendar, or any payment processor. Your use of those services is governed by their own terms and is your responsibility.
12. Indemnity
You agree to indemnify and hold harmless Aero Imagery and its officers, employees, and agents from and against any claim, loss, damage, liability, cost, or expense (including legal fees) arising out of or in connection with:
- Your use of the Service
- Your Content, including any client data you enter
- Your drone operations, flight decisions, and business activities
- Any act or omission in the course of your business, including any damage, injury, or harm caused to any person or property
- Any engagement, work, or relationship between you and a client, including where the client found you through the Public Directory
- Your breach of these Terms
- Your violation of any law, including CASA regulations, or the rights of any third party
- Any claim made against us by a client or third party arising out of your work or conduct
You must not bring or maintain any claim against us that seeks to hold us liable for your own operations, information, or business tasks, or for the conduct of any other pilot, except to the extent that such liability cannot be lawfully excluded under the Australian Consumer Law.
We reserve the right to assume the exclusive defence of any matter for which you are required to indemnify us, and you will cooperate with us in that defence.
13. Termination & Account Deletion
Voluntary deletion. You can delete your account at any time through the Service. Account deletion triggers a grace period during which you can reactivate your account. After the grace period, your data is permanently deleted.
Suspension. We may suspend or restrict access to the Service if you breach these Terms, fail to pay subscription fees, or if we believe your use poses a risk to the Service, other users, or third parties.
Termination by us. We may terminate your account for serious or repeated breaches of these Terms. We will provide notice where practicable, except in cases of urgent safety or legal risk.
Effect of termination. Upon termination, your right to use the Service ends. Your data will be handled in accordance with our data retention practices described in the Privacy Policy.
Survival. Provisions that by their nature should survive termination — including ownership, intellectual property, indemnity, and limitation of liability — will remain in effect after termination.
14. Dispute Resolution
If a dispute arises out of or relates to these Terms or the Service, the parties agree to:
- First, attempt to resolve the dispute through good faith negotiation within 30 days of written notice
- If negotiation fails, attempt mediation through a mediator agreed by both parties
- If mediation fails, the dispute may be submitted to the courts of Victoria, Australia
15. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.
16. Changes to These Terms
We may update these Terms from time to time. We will notify users of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription and delete your account.
17. General
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aero Imagery regarding the Service.
Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign these Terms without our consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
No partnership. Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and us.
